Since 1 June 2020, the provision under Section 17A MACC Act 2009 is a provision that stipulates a corporate liability principle where a commercial organization can be considered guilty if any of its employees and/or associates commit corruption for the benefit of the organization.
The organization involved in corruption activities to be subjected to legal action and persons associated with the organization would be deemed to commit the corresponding offence unless it can be proven that adequate procedures have been put in place.
In light of the above, senior management and team must be aware and keep abreast with the requirements of the Section 17A of the MACC Act 2009 to ensure that their commercial organization's adequate procedures, anti-corruption programme and policies are well adopted, implemented and enforced.
